1. Introduction
This Acceptable Use Policy ("AUP") defines prohibited uses of OTAlytics's services. This policy is designed to protect our users, our infrastructure, and third-party platforms we integrate with.
By using OTAlytics, you agree to comply with this AUP in addition to our Terms of Service. Violations may result in suspension or termination of your account without refund.
This policy applies to all users, regardless of subscription plan (Free, Starter, Growth, or Pro).
2. General Prohibitions
You may NOT use OTAlytics to:
2.1 Illegal Activities
- Violate any local, national, or international laws or regulations
- Engage in fraud, theft, or deceptive practices
- Launder money or engage in financial crimes
- Violate export control or sanctions laws
- Distribute illegal content or contraband
2.2 Abuse and Harm
- Harass, threaten, or abuse other users or our staff
- Discriminate based on race, religion, gender, sexual orientation, disability, or other protected characteristics
- Impersonate another person or entity
- Share graphic, violent, or hateful content
- Engage in cyberbullying or stalking
2.3 Security and Technical Abuse
- Attempt to gain unauthorized access to our systems or other users' accounts
- Probe, scan, or test the vulnerability of our systems
- Bypass authentication, security measures, or rate limits
- Use automated tools (bots, scrapers) to access the Service beyond normal usage
- Reverse engineer, decompile, or disassemble any part of the Service
- Distribute viruses, malware, ransomware, or other harmful code
- Launch denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
- Interfere with the Service or servers hosting the Service
2.4 Intellectual Property Violations
- Infringe on copyrights, trademarks, patents, or other intellectual property rights
- Share pirated content or counterfeit goods
- Use our trademarks, logos, or branding without permission
- Claim ownership of our intellectual property
2.5 Spam and Unsolicited Communications
- Send spam, unsolicited emails, or bulk messages through our Service
- Use the Service for phishing, social engineering, or scam campaigns
- Harvest email addresses or personal data from other users
3. Service-Specific Rules
3.1 Tour Tracking
You may ONLY track tours that you own, operate, or have explicit authorization to monitor.
- Permitted: Tracking your own tour listings on GetYourGuide, Viator, or Tripadvisor
- Permitted: Tracking tours you manage on behalf of a client (with authorization)
- Prohibited: Tracking competitors' tours without authorization for competitive intelligence purposes
- Prohibited: Tracking tours to manipulate rankings or harm competitors
Note: While our Service may display competitor rankings for context, you should only track tours you have the right to monitor.
3.2 OTA Platform Compliance
You must comply with the terms of service of the OTA platforms we integrate with:
- GetYourGuide: Respect GetYourGuide's supplier terms and community guidelines
- Viator: Comply with Viator's supplier terms and policies
- Tripadvisor: Follow Tripadvisor's terms of use and review policies
You may NOT use ranking data from our Service to:
- Manipulate search rankings artificially
- Game platform algorithms
- Submit fake reviews or engagement
- Violate platform anti-manipulation policies
3.3 Data Scraping and Export
- Permitted: Exporting your own ranking data via our dashboard (CSV, JSON)
- Prohibited: Scraping our website or API to extract large datasets
- Prohibited: Using our data to build competing products or services
- Prohibited: Selling or redistributing data obtained from our Service
3.4 API Usage (Future)
If we offer an API in the future, you must:
- Respect rate limits and usage quotas
- Not share API keys or credentials
- Not use the API to create competing services
- Follow API-specific terms and documentation
4. Account Security
4.1 Credential Protection
- Prohibited: Sharing your account credentials (email, password) with others
- Prohibited: Creating multiple accounts to circumvent plan limits
- Prohibited: Allowing multiple people to use a single account (exception: team plans, when available)
- Required: Using a strong, unique password
- Required: Enabling two-factor authentication (2FA) when available
4.2 Account Responsibility
You are fully responsible for all activities that occur under your account. If you suspect unauthorized access:
- Change your password immediately
- Notify us at support@otalytics.com
- Review recent activity in your account settings
4.3 Account Resale
- Prohibited: Selling, renting, or transferring your account to others
- Prohibited: Reselling our Service as a white-label product
5. Data Usage Limits
5.1 Fair Use Policy
While we offer unlimited rankings on the Pro plan, we enforce a "fair use" policy to prevent abuse:
- Reasonable Use: Adding tours and keywords for legitimate business purposes
- Excessive Use: Adding thousands of tours solely to stress-test our system or resell data
If we detect excessive usage that negatively impacts our infrastructure or other users, we may:
- Contact you to discuss your use case
- Implement temporary rate limits
- Require you to upgrade to a custom enterprise plan
- Suspend your account if abuse continues
5.2 Resource Limits
To maintain service quality for all users, we may impose the following limits:
- API Requests: Rate limits on dashboard actions (e.g., 100 requests per minute)
- Data Export: Maximum file size of 100MB per export
- Concurrent Sessions: Maximum 3 active sessions per account
5.3 Storage Limits
Historical data is subject to plan-specific retention limits:
- Free: 30 days
- Starter: 90 days
- Growth: 180 days
- Pro: Unlimited (subject to fair use)
Excessive storage usage (e.g., adding/removing thousands of tours daily to generate data) may be flagged for review.
6. Legal Compliance
6.1 Data Protection Laws
You must comply with applicable data protection laws, including:
- GDPR: If you process data of EU residents
- CCPA: If you process data of California residents
- Other regional laws: As applicable to your jurisdiction
Do NOT use our Service to collect or process personal data in violation of privacy laws.
6.2 Business Conduct
You must:
- Have the legal right to operate tours you track
- Comply with all applicable business licenses and permits
- Not use our Service to facilitate illegal tour operations
- Respect consumer protection laws in your jurisdiction
6.3 Third-Party Rights
You must not use our Service to:
- Infringe on third-party trademarks, copyrights, or patents
- Violate contractual obligations to other parties
- Misappropriate trade secrets or confidential information
7. Reporting Violations
7.1 How to Report
If you become aware of a violation of this AUP by another user, please report it to:

- Date and time of the incident
7.2 Investigation
We will investigate all reports and take appropriate action, which may include:

- Suspending the account temporarily
- Terminating the account permanently
- Reporting to law enforcement (if illegal activity is suspected)
7.3 Confidentiality
We will handle reports confidentially and will not disclose your identity to the reported user unless required by law.
7.4 False Reports
Submitting false or malicious reports is a violation of this AUP and may result in action against your account.
8. Consequences of Violations
8.1 Warning
For minor or first-time violations, we may issue a warning and request that you correct the behavior. You will be given a reasonable timeframe to comply.
8.2 Temporary Suspension
For serious or repeated violations, we may suspend your account temporarily (e.g., 7-30 days) while we investigate. During suspension:
- You will not have access to the Service
- Your subscription will not be paused or refunded
- Your data will be retained
8.3 Permanent Termination
For severe violations (illegal activity, fraud, security threats), we may terminate your account permanently without notice or refund. This includes:
- Immediate account closure
- Deletion of all data within 30 days
- No refund for current or past billing periods
- Ban from creating new accounts
8.4 Legal Action
In cases of illegal activity or significant harm, we reserve the right to:
- Report violations to law enforcement
- Cooperate with legal investigations
- Pursue civil or criminal action
- Seek damages and legal fees
8.5 No Refunds
Accounts terminated for AUP violations are not eligible for refunds, regardless of when the violation occurred or how much time remains in the billing period.
9. Changes to This Policy
We may update this Acceptable Use Policy from time to time to reflect:
- New features or services
- Changes in legal requirements
- Lessons learned from abuse incidents
- Feedback from users and stakeholders
We will notify you of material changes by:
- Posting a notice on our website
- Sending an email to your registered email address
- Updating the "Last Updated" date at the top of this policy
Your continued use of the Service after changes take effect constitutes acceptance of the updated policy.
